What should I look for in a lawyer? And how should I go about it? Our fearless barrister knows.
Local attorney Joseph S. Passanise, who is writing a book called Busted: College Kids Have Rights, Too!, has agreed to answer some of our questions on topics that could affect our readers. This week: How to go about selecting a lawyer, and the questions and expectations you should have during the process. Take it away, Joe.
I’ve heard many “lawyer jokes” and recognize that there is a real hostility toward us. Yet many lawyers are known for their achievements and high standards of integrity. They work long hours to serve others while trying to maintain integrity in a competitive setting. Success is measured by client satisfaction as opposed to justice.
Behind every dubious lawyerly act there is a client demanding even more aggressive action to be taken. Clients hire lawyers to find loopholes around regulations, avoid taxes, gain advantages over others or simply get them out of trouble while showing little concern for the opposing side. Saying “no” to a client is a difficult proposition; there will be a lot of pressure put on them if they do so.
One of the most responsible things that you can do is hire an attorney and seek advice early on so you’re aware of the process and have a plan. Don’t wait until charges are filed.
If you are looking to hire a lawyer, you need to know what to expect from him or her. These include:
• Hard work
• Investigation of your case
• Listening to your concerns
• Answering your questions
• Providing advice and counsel.
If you’ve been arrested or you’re under investigation, you can aid your lawyer by telling the complete truth, concealing no facts. A lawyer cannot defend you unless he knows the good and the bad. He is the only one protecting you.
In choosing a lawyer:
• Look for a lawyer specialized in cases like yours and with experience trying such cases.
• Your lawyer should have the ability to listen, persuade and advocate. You’re looking for a lawyer, not a friend.
• Get referrals from friends and other lawyers.
• Interview and meet lawyers. We usually want to make things convenient and quick, but if you’ve been arrested or you’re facing a criminal charge you need to take the time to ask questions. This will be worth it in the long run.
An ideal lawyer should be knowledgeable and positive yet cautious, pointing out strengths and weaknesses. You don’t want a lawyer just to tell you what you want to hear. Ethically, no lawyer can predict results.
You want a lawyer with proven experience and work habits. Ask the lawyer if you are going to receive copies of important documents and be kept informed of all major developments in your case.
Once you’ve hired an attorney, help your lawyer as you place your faith in them. Don’t work against him, as he or she has your best interests at heart.
